These Terms of Service govern your use of the LIONEL.MKTG website, your purchase of any products or digital downloads, your enrollment in any courses, and your subscription to any newsletters or communication from LIONEL.MKTG. By visiting this website, making a purchase, or subscribing to any communication, you agree to these terms. If you do not agree, do not use this site or purchase any products.


LIONEL.MKTG is operated by Lionel Lowery in North Carolina.

PART 1: DEFINITIONS


"Commercial License" means an upgraded license, purchased separately or confirmed in writing by LIONEL.MKTG, that permits use of a digital product to create work delivered to or on behalf of a paying third-party client. A standard purchase does not include a Commercial License.


"Digital Products" means any downloadable item sold through this site, including templates, ebooks, guides, workbooks, and design assets.


"Physical Products" means any tangible item shipped to you, including books, merchandise, and printed materials.


"Courses" means any online educational program, workshop, or training offered through this site or a connected platform, whether delivered via video, audio, written materials, or live sessions.


"Content" means all text, graphics, images, audio, video, and other material on this site, including free and paid resources.


"User" means any person who visits, browses, purchases from, or interacts with this site.

PART 2: USE OF THIS SITE


1. ELIGIBILITY


By using this site you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are purchasing on behalf of an organization, you represent that you have authority to bind that organization to these terms.


2. PERMITTED USE


You may use this site for personal and professional purposes consistent with these terms. You may not use this site or any content from it for any unlawful purpose, to infringe on the rights of others, to transmit harmful or offensive material, or to interfere with the site's operation.


3. ACCOUNT REGISTRATION


If you create an account on this site, you are responsible for maintaining the security of your login credentials and for all activity that occurs under your account. Notify me immediately at the contact information below if you believe your account has been compromised.


4. INTELLECTUAL PROPERTY


All content on this site, including text, graphics, logos, images, course materials, frameworks, templates, and design assets, is owned by Lionel Lowery / LIONEL.MKTG or licensed for use by LIONEL.MKTG. Nothing on this site transfers ownership of that content to you except as explicitly stated in the product-specific terms below.


You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this site without express written permission.

PART 3: DIGITAL PRODUCTS


5. LICENSE FOR DIGITAL PRODUCTS


When you purchase a digital product from LIONEL.MKTG, you receive a limited, non-exclusive, non-transferable, personal license to use that product for your own personal or business purposes. This license is granted upon completion of payment and does not transfer ownership of the underlying intellectual property. Each purchase licenses one individual user. This license does not extend to teammates, employees, or other users within the same organization without a separate purchase or a team license agreement.


If you are an employee purchasing on behalf of your employer, the license is still granted to you as an individual. Your employer does not automatically receive a license by virtue of your purchase. Use of the product by other employees, team members, or departments requires a separate purchase or a team license agreement.


The single-user license permits use for internal business purposes within your own organization. It does not cover use where the output is delivered to or on behalf of a third party, whether you are acting as a freelancer, a contractor, or as an employee whose employer delivers the work to its own clients. Any use where the finished output reaches a paying third party requires a Commercial License regardless of whether the buyer is self-employed or working within a company.


If you need access for multiple team members or employees, contact me to discuss team licensing options before sharing files.


You may use templates, workbooks, and similar assets to create end products for your own personal use or for your own business. Using a digital product to create work on behalf of a paying client, or delivering a product or its output as part of a service you provide to others, requires a commercial license. Commercial use for client work is not included in the standard purchase price. Contact me before purchasing if you intend to use a product for client deliverables and I will confirm whether a commercial license is available and at what cost.


You may not resell, redistribute, share, sublicense, or transfer the original files to any third party. You may not claim authorship of the original product or present it as your own creation for resale. Use of a digital product beyond the scope of your purchased license, including client work without a Commercial License, is a violation of these terms and may result in suspension of access and legal action.


Not all digital products contain third-party licensed elements. If you want to know what a specific product contains before purchasing, contact me and I can tell you which elements, if any, are sourced from third-party platforms. Where third-party elements are present, they are licensed for single-user personal and business use. If you intend to use a product containing third-party elements to create work for a paying client, those elements may require a separate license depending on the end use. I hold valid licenses for these elements for my own use and for standard personal and business end products. I cannot guarantee their clearance for all possible end uses, including but not limited to government contract submissions, federally funded grant materials, or other applications with specialized licensing requirements. It is your responsibility to verify that the product and any included elements are suitable for your specific use case before purchasing.


If you need a written confirmation of your license for a specific product, such as for a client, legal review, or compliance documentation, contact me and I will provide a license confirmation letter upon request.


6. FILE ACCESS AND COMPATIBILITY


Digital products are delivered as working files in the software format specified on the product page. Software requirements vary by product and may include Canva, Adobe Express, Adobe Illustrator, Adobe Premiere Pro, or other programs, and may expand as new products are added. The required software for each product is listed in the product description before purchase. Purchasing a digital product does not include a license to any software needed to open or edit it. You are responsible for having access to the appropriate software and account tier before purchasing. I do not provide access to my software accounts or licenses. I am not responsible for compatibility issues arising from software version differences, account tier restrictions, or platform changes. If you have trouble accessing a file after purchase, contact me and I will do my best to assist, but I cannot guarantee compatibility with every software configuration.


7. DELIVERY OF DIGITAL PRODUCTS


Digital products are delivered via download link or email upon payment confirmation. If you do not receive your download within 24 hours of purchase, contact me at the information below before initiating a dispute with your payment provider.


8. NO UNAUTHORIZED SHARING


Purchasing a digital product gives you access for your own use only. Sharing, gifting, posting publicly, or distributing the product to others, whether for free or for payment, is a violation of these terms and may result in legal action. Each purchase is licensed to one user.

PART 4: COURSES


9. COURSE ACCESS


Upon enrollment and payment, you receive access to the course for the duration specified on the course page. Where no duration is specified, access is provided for 12 months from the date of enrollment. Access is granted to one individual only and may not be shared, transferred, or resold.


I reserve the right to change the platform on which course content is delivered. In the event of a platform change or migration, I will make reasonable efforts to transfer your access and notify you in advance. If course content becomes permanently inaccessible before your access term ends due to a platform closure or technical failure on my end, I will offer a replacement format or partial credit at my discretion.


10. COURSE CONTENT OWNERSHIP


All course materials, including videos, audio recordings, written guides, workbooks, slide decks, and supplementary resources, are owned by Lionel Lowery / LIONEL.MKTG. You may use course materials for your own learning and professional development. You may not record, reproduce, distribute, resell, or publicly share any course content in any format. This prohibition includes recording by any means, including screen recording software, mobile devices, external cameras pointed at a screen, and any other method of capturing audio or video content from course materials.


11. NO RESULTS GUARANTEE


Course content is provided for educational and informational purposes. I share strategies, frameworks, and approaches that reflect my own experience and professional judgment. I cannot guarantee specific outcomes, results, revenue, traffic, or business growth from any course. Your results depend on your own effort, market conditions, industry, and many other factors outside my control. Course descriptions are provided on the course page before purchase. It is your responsibility to review the course description, scope, and subject matter before enrolling. Enrollment constitutes acceptance that the course content and scope meet your needs.


12. COURSE CONDUCT


If a course includes live sessions, community access, or interactive components, you agree to engage respectfully with me and other participants. I reserve the right to remove any participant from a course without refund for behavior that is disruptive, harassing, abusive, or otherwise harmful to the learning environment.


13. GROUP AND MULTI-SEAT COURSE ENROLLMENTS


If you purchase multiple seats or enroll a team, each seat is a separate license for one individual. No refund is available for unused seats. Transfer of an unused seat to another individual within your organization requires my written approval and must be requested at least 48 hours before the course end date. Seats may not be transferred outside your organization.

PART 5: PHYSICAL PRODUCTS AND MERCHANDISE


14. PRODUCT DESCRIPTIONS


I make reasonable efforts to ensure product descriptions, images, and specifications are accurate. Minor variations in color, size, or appearance may occur, particularly for printed and handcrafted items. These variations do not constitute a defect.


15. SHIPPING AND DELIVERY


Shipping timelines are estimates and are not guaranteed. I am not responsible for delays caused by carriers, customs, weather, or other circumstances outside my control. Risk of loss transfers to you once the item is handed to the carrier.


16. DAMAGED OR DEFECTIVE PHYSICAL PRODUCTS


If a physical product arrives damaged or defective, contact me within 7 days of delivery with a photo of the damage. I will replace the item or issue a refund at my discretion. I am not responsible for damage caused after delivery.

PART 6: NEWSLETTER AND COMMUNICATIONS


17. NEWSLETTER SUBSCRIPTION


By subscribing to the LIONEL.MKTG newsletter, you consent to receive periodic emails containing marketing content, business insights, updates, and promotional material. You can unsubscribe at any time by clicking the unsubscribe link in any email. Unsubscribe requests are processed within 3 business days of receipt. If you are enrolled in an automated email sequence at the time of your unsubscribe request, you will be removed from active marketing lists within that window, but emails already queued or in-progress within the automation may still deliver due to platform processing timing. This is a technical limitation of email automation systems, not a failure to honor your request. Automated sequence emails that send during the processing window do not constitute a violation of your unsubscribe. Unsubscribing removes you from the newsletter list but does not delete your account or purchase history if applicable.


18. CAN-SPAM COMPLIANCE


All marketing emails from LIONEL.MKTG comply with the CAN-SPAM Act. Every email includes a clear way to opt out, a designated mailing address, and accurate sender information. I do not send unsolicited bulk email.


19. TRANSACTIONAL EMAILS


Purchasing a product or enrolling in a course may result in transactional emails related to your order, delivery, access, or account. These are not marketing emails and cannot be unsubscribed from while your order or enrollment is active.

PART 7: PAYMENTS AND PRICING


20. PRICING


All prices are listed in US dollars. Prices are subject to change without notice. The price displayed at checkout is the price you pay. Promotional pricing is valid only during the stated promotional period.


21. PAYMENT PROCESSING


Payments are processed through secure third-party processors. I do not store your full payment card information. By completing a purchase, you agree to the terms of the payment processor used at checkout.


22. TAXES


You are responsible for any applicable sales tax, VAT, or other taxes on your purchase. Where required by law, applicable taxes will be added at checkout. If you are located in the European Union, VAT may apply to digital product purchases under EU digital services tax rules. The applicable rate will be calculated at checkout based on your location.


23. CHARGEBACKS


Filing a chargeback or payment dispute without first contacting me to resolve the issue is a violation of these terms. If a chargeback is filed, I reserve the right to suspend or terminate your access to any digital products or courses you purchased. Fraudulent chargebacks may be pursued legally.

24. NO PROFESSIONAL ADVICE


Content on this site, including course materials, blog posts, newsletters, templates, and all other resources, is for informational and educational purposes only. It does not constitute legal, financial, accounting, or professional business advice. Always consult a qualified professional before making legal, financial, or business decisions.


25. NO GUARANTEED OUTCOMES


I do not guarantee any specific results, outcomes, income, revenue, traffic, or business growth from the use of any product, course, template, or content on this site. Results vary significantly based on individual effort, industry, market conditions, and many other factors outside my control.


26. LIMITATION OF LIABILITY


To the fullest extent permitted by law, LIONEL.MKTG and Lionel Lowery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site, any product, or any course. Our total liability for any claim shall not exceed the amount you paid for the specific product or course at issue. Nothing in this section limits liability arising from fraud, willful misconduct, or gross negligence.


27. AS-IS BASIS


All products, courses, and content are provided on an as-is basis. I make no warranties, express or implied, regarding fitness for a particular purpose, accuracy, completeness, or uninterrupted access.

This applies to submissions made through this site, via email, or through any public channel. There is no removal right for general submissions made under these terms. If you are an active client under a signed Client Service Agreement, the testimonial terms in that agreement govern instead and include a removal mechanism.

PART 10: GENERAL


31. GOVERNING LAW


These terms are governed by the laws of the State of North Carolina. Any legal action arising from these terms shall be brought in the state or federal courts located in Forsyth County, North Carolina.


32. DISPUTE RESOLUTION


Before initiating any legal action, you agree to contact me in good faith to attempt to resolve the dispute directly. I will acknowledge dispute inquiries within 5 business days and make a good faith effort to respond substantively within 15 business days of receipt. If resolution cannot be reached within 30 days of initial contact, either party may pursue available legal remedies.


33. CHANGES TO THESE TERMS


I may update these terms at any time. Material changes will be noted with an updated date at the top of this page. Continued use of this site after changes are posted constitutes acceptance of the updated terms.


34. SEVERABILITY


If any provision of these terms is found unenforceable, the remaining provisions continue in full effect.


35. ENTIRE AGREEMENT


These terms, together with the Privacy Policy and Refund Policy available at lionel.marketing, constitute the full agreement between you and LIONEL.MKTG regarding your use of this site and purchase of products.
